While many EU countries (including France, Italy and Austria) have already transposed the directive into national law, Germany is lagging behind. As of today (23.01.2024), the corresponding law has not yet been passed in the Federal Republic of Germany.  <\/p>\n<p><span style=\"font-style: inherit; font-weight: inherit; text-align: var(--text-align); background-color: var(--ast-global-color-5); color: var(--ast-global-color-3);\">This delay is causing considerable uncertainty for companies.  <\/span><a style=\"font-style: inherit; font-weight: inherit; text-align: var(--text-align);\" href=\"https:\/\/table.media\/wp-content\/uploads\/2024\/12\/17215006\/CSRD-Proposal.pdf\" target=\"_blank\" rel=\"noopener\">In particular, the German government&#8217;s pushback against the EU<\/a><span style=\"font-style: inherit; font-weight: inherit; text-align: var(--text-align); background-color: var(--ast-global-color-5); color: var(--ast-global-color-3);\"> &#8211; for example, with regard to the requirements for <a href=\"https:\/\/csr-tools.com\/en\/blog-en\/double-materiality-double-materiality-explained-simply\/\">double materiality<\/a> and the strict reporting standards of the ESRS &#8211; has further complicated the situation. Many companies are asking themselves: What rules will really apply from 2025 and how do I prepare for them? <\/span><\/p>\n<p><span style=\"font-style: inherit; font-weight: inherit; text-align: var(--text-align); background-color: var(--ast-global-color-5); color: var(--ast-global-color-3);\">In the midst of this uncertainty, it is crucial to maintain an overview. Although the EU has issued clear guidelines, Germany has not yet implemented them into national law. Here are the most important events in chronological order:  <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ef4d43f elementor-widget elementor-widget-heading\" data-id=\"ef4d43f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">CSRD implementation in Germany: by July 2024<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eed96ed elementor-widget elementor-widget-text-editor\" data-id=\"eed96ed\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><b>1. adoption of the CSRD at EU level (November 2022)<\/b><\/p>\n<p>The EU has officially adopted the CSRD with the aim of comprehensively standardizing sustainability reporting for companies. The directive came into force on January 5, 2023, and the member states were obliged to transpose it into national law by July 6, 2024 at the latest.   <\/p>\n<p><b>2. German draft bill on CSRD implementation (March 2024)<\/b><\/p>\n<p>A <a href=\"https:\/\/www.bmj.de\/SharedDocs\/Gesetzgebungsverfahren\/DE\/2024_CSRD_UmsG.html\" target=\"_blank\" rel=\"noopener\">draft bill<\/a> for the German CSRD Implementation Act was published back in March 2024, but was not officially published. This draft indicated that Germany wanted to adopt the requirements of the EU directive 1:1 without making any specific adjustments or simplifications for companies. This approach was strongly criticized by business associations, as it would have completely taken over the already complex reporting obligations of the ESRS.  <\/p>\n<p><b>3. delay in implementation in Germany (July 2024)<\/b><\/p>\n<p>The German government missed the legal deadline for national implementation, which expired on July 6, 2024. This led to growing uncertainty among companies that will have to comply with the new requirements for the first time from the 2025 reporting year. <\/p>\n<p><b>4. government draft on the German CSRD implementation (July 2024)<\/b><\/p>\n<p>On July 24, 2024, the Federal Ministry of Justice (BMJ) published a government draft on CSRD implementation in Germany. This draft provided for the almost complete transposition of the European CSRD requirements into German law, including the ESRS. Only a few adjustments were made to reflect national circumstances.  <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-686696e elementor-widget elementor-widget-heading\" data-id=\"686696e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">CSRD implementation in Germany: from July 2024<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d919ae4 elementor-widget elementor-widget-text-editor\" data-id=\"d919ae4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><b style=\"font-style: inherit; text-align: var(--text-align); background-color: var(--ast-global-color-5); color: var(--ast-global-color-3);\">5. EU publishes updated German translation of the CSRD (August 2024)<\/b><\/p>\n<p>In August 2024, <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/TXT\/?uri=OJ:L_202490457\" target=\"_blank\" rel=\"noopener\">a corrigendum to the German version of the CSRD was published in the EU Official Journal<\/a>. This correction clarified linguistic inaccuracies in the original translation of the directive. In particular, the terms and requirements for <a href=\"https:\/\/csr-tools.com\/en\/blog-en\/csrd-reporting-materiality-analysis-and-then\/\">double materiality and the reporting obligations<\/a> were defined more precisely. The aim of the correction was to avoid misunderstandings in practical application and to provide German companies with greater clarity.   <\/p>\n<p><b>6th EU announces&nbsp;Omnibus initiative to simplify reporting obligations (November 2024)<\/b><\/p>\n<p>In November 2024, the European Commission announced the introduction of a <a href=\"https:\/\/csr-tools.com\/en\/?p=5482\">CSRD Omnibus<\/a> proposal in the Budapest Declaration. This package aims to consolidate the Corporate Sustainability Reporting Directive (CSRD), the Corporate Sustainability Due Diligence Directive (CSDDD) and the <a href=\"https:\/\/csr-tools.com\/en\/blog-en\/eu-taxonomy-csrd-what-companies-need-to-know\/\">EU taxonomy<\/a> in order to simplify reporting obligations for companies and reduce bureaucratic hurdles. <\/p>\n<p><b>7. pushback by the German government towards the EU (December 2024)<\/b><\/p>\n<p>The German government officially lobbied the EU Commission to simplify the requirements of the CSRD. Among other things, it called for <\/p>\n<ul>\n<li>A reduction in <a href=\"https:\/\/csr-tools.com\/en\/blog-en\/esrs-data-point-mapping-7-essential-tips-insights\/\">ESRS data points<\/a><\/li>\n<li>Measures to counter the &#8220;trickle-down&#8221; effect along the supply chain to relieve SMEs<\/li>\n<li>A postponement of the reporting obligations by two years<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-2d30770 e-flex e-con-boxed e-con e-parent\" data-id=\"2d30770\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-dfdaedd elementor-widget elementor-widget-heading\" data-id=\"dfdaedd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What should German companies do now?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-90083de elementor-widget elementor-widget-text-editor\" data-id=\"90083de\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The non-implementation of EU directives usually has considerable legal and financial consequences for member states. For companies, this often means legal uncertainty and additional expense. Early action and orientation towards EU requirements are therefore advisable, particularly in the case of directives such as the CSRD, which have far-reaching effects on companies.  <\/p>\n<p>Despite the delayed national implementation of the CSRD, German companies should actively prepare for the new requirements. As the <a href=\"https:\/\/csr-tools.com\/en\/?page_id=5120\">European Sustainability Reporting Standards (ESRS)<\/a> have already been adopted, they provide a clear basis for reporting.   <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c20977c elementor-widget elementor-widget-heading\" data-id=\"c20977c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">How you can prepare despite the lack of CSRD implementation in Germany<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8ed2e39 elementor-widget elementor-widget-text-editor\" data-id=\"8ed2e39\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Companies should primarily focus on so-called &#8216;no-regret moves&#8217;. &#8220;No Regret Moves&#8221; are risk-free, forward-looking measures that help companies to overcome the uncertainties surrounding CSRD implementation in Germany. They not only create future compliance, but also promote efficiency, transparency and competitiveness &#8211; regardless of the final implementation of the directive. We recommend this:   <\/p>\n<ol>\n<li><b>Clarify responsibilities<\/b>: If you have not already done so, define which individuals and teams should assume responsibility and <a href=\"https:\/\/csr-tools.com\/en\/blog-en\/sustainability-reporting-who-takes-on-the-key-roles\/\">key roles in sustainability reporting<\/a>.  <\/li>\n<li><b>Carry out<a href=\"https:\/\/csr-tools.com\/en\/materiality-analysis\/\">a double materiality analysis<\/a><\/b>: The DWA offers companies long-term benefits, regardless of regulatory changes. It creates the basis for well-founded sustainable decisions and <a href=\"https:\/\/csr-tools.com\/en\/blog-en\/csrd-materiality-analysis-strategic-tool-for-companies\/\">strategic action<\/a>, regardless of how regulatory requirements develop. In addition, the materiality analysis is at the heart of the CSRD and it is therefore hard to imagine that the DWA will no longer be relevant in the Omnibus Initiative.<br \/>We recommend this <a href=\"https:\/\/csr-tools.com\/en\/materiality-analysis-template\/\">materiality analysis Excel template<\/a> or the use of the <a href=\"https:\/\/materialitymaster.com\/de\/\" target=\"_blank\" rel=\"noopener\">Materiality Master software<\/a> to carry out the DWA as cost-effectively and time-efficiently as possible.  <\/li>\n<li><b>Writing a simplified CSRD (test) report<\/b>: In addition to the comprehensive CSRD reporting requirements, EFRAG has also published a simplified and voluntary CSRD guideline: the <a href=\"https:\/\/www.efrag.org\/en\/projects\/voluntary-reporting-standard-for-smes-vsme\/concluded\" target=\"_blank\" rel=\"noopener\">ESRS VSME standard<\/a>.
